Builder fined for asbestos risk due to negating to carry-out an asbestos survey
A self-employed builder has been fined for demolishing a building without first carrying out an asbestos survey
Stuart Pearson was prosecuted by the Health and Safety Executive (HSE) at Guildford Magistrates’ Court for breaching the Control of Asbestos Regulations between 20 April and 1 May 2011.
The court was told that he had been employed to carry out the demolition of a house in Woking, Surrey, before ground works were laid for a new property.
He was fined £5,000 and ordered to pay costs of £7,500.

Government cuts for asbestos related compensation claims
Workers with illnesses linked to asbestos are dying without compensation due to cutbacks put in place by the Government.
A new law to speed up compensation by letting sufferers claim from their employers’ insurers was agreed two years ago.
However, that new law will not come into force until – at the earliest – 2013, thanks to “shrinking departmental resources” at the Ministry of Justice.
In the three-year delay almost 15,000 people with debilitating diseases such as mesothelioma could die, the Health and Safety Executive has predicted.
Compensation lawyer Chris Shaw said: “The Government needs to rethink its decision. Many of these people do not have the luxury of being able to wait. It’s a disgrace.”
A new Ministry of Justice report said that tackling the severe economic situation meant “very worthwhile but less immediately pressing law reform projects have, in some cases, been delayed.”

Asbestos disposal and handling regulations amended April 2012
Less than a week ago HSE’s official Asbestos Regulations for the control and handling of this dangerous substance were amended and re-published on the HSE official website.
The latest HSE regulations have been updated to take into consideration the new European Commission’s view which was that the UK hadn’t completely implemented a full EU Directive regarding asbestos exposure (Directive 2009/148/EC).
The latest changes to legal regulations for asbestos disposal include some additional requirements regarding non-licensed work with particular emphasis on; notification of work, medical surveillance and record keeping. All other asbestos regulations remain unchanged.

Asbestos Removal Luton – Council Have a Plan of Action
Luton Borough council claim to have carried out non destructive surveys, on nearly 10% of all their properties in a hope to identify the locations of any asbestos based materials.
They have carried out asbestos reports on most dwellings and were asbestos has been found in one type of property it is assumed all properties are the same.
The council carry out annual reports and manage and remove were appropriate, asbestos removal Luton council will only remove when necessary.

Development Company Fined for Failure to Carry out Asbestos Test
HSE has prosecuted a partner of a Kent based development company, when they found the company guilty of not complying to asbestos regulations on a site in Dover.
Failure to carry out an asbestos test and assessment of the site left the HSE with no option but to charge the contractor.
Magistrates’ Court heard that the development company who were the main contractor on a site at the Royal Oak Public House, Sandwich Road, Whitfield, Dover.
After receiving a complaint from the general public the HSE investigated and found that the site had not had an asbestos demolition survey carried out and even after an improvement notice was received the company did not carry out the report as requested.
After the hearing, HSE’s Inspector Caroline Penwill said:
“Mr Smith did not think about the risks he may have exposed his workers and members of the public to by cutting corners.
“Before anyone undertakes any demolition works they must consider whether asbestos is present and take precautionary steps such as carrying out an asbestos survey.
“The site was also very unsecure and exposed local children to the hazards of a building site. What makes this case all the more disappointing is that Mr Smith continued to work after the HSE advised him to undertake an asbestos survey.
Allan Smith has pleaded guilt and charged under Regulation 5 of the Control of Asbestos Regulations 2006 and Regulation 27(2) of the Construction (Design and Management) Regulations 2007. With costs and the HSE fine he was forced to pay £14,000.00.
The importance of getting a survey is there for all to see.

Why get a Type 3 Asbestos
Whenever you are looking to demolish or refurbish a property you should always carryout an asbestos survey. Formally called a type 3 asbestos survey they are now more communally known as refurbishment/demolition survey. Asbestos Containing Drywall Removal
A couple of our lads were working in Bristol yesterday. They were asked to carry out some asbestos containing drywall removal in a house built in the 1950s. Knocking down the wall they discovered a batch of photographs and some old bank notes tied together by string. We showed the owner of the house the discovery and she is now making investigations in to how it got there, who put it there and who the money belongs to. It’s one thing discovering asbestos in your house, but it’s another thing discovering old mementos and hard cash!

Asbestos Death Man Gives Evidence on His Own Death
A statement written by a man four days before he died from asbestos-related cancer was read out as evidence at an inquest into his own death.
Evidence from Clifford Baker, of Knowle, Bristol, about how he was exposed to asbestos in his working life was read out at the hearing at Flax Bourton Coroner’s Court.
The retired carpenter and joiner, of Langton Road, had been exposed to asbestos dust for most of his working life, since he first became an apprentice at a carpentry and joinery firm in Clifton in 1961, the inquest heard.
Mr Baker, 64, would often have to sweep up asbestos dust, cut fire doors containing asbestos and fix asbestos ceiling panels on local properties.
After his apprenticeship and throughout his working life, he was on a number of occasions exposed to a lot of dust, which he believed to contain asbestos.
In his statement, dad-of-two Mr Baker said: “In all this time I was not warned about the danger of asbestos exposure, nor was I given a mask sufficient to prevent inhalation of asbestos particles.”
His wife Jane, a housewife, and his daughters Charlotte and Catherine were in court for the hearing on Friday.
Mr Baker fell ill in March 2009, and at first it was believed he had a chest infection. He was given antibiotics, but this did not clear the infection
